Refund & Cancellation Policy

This Refund & Cancellation Policy explains how subscription cancellations, refunds, failed payments, and plan changes work for Litigo ("Litigo", "we", "our", or "us").

This Policy applies to subscriptions purchased through the Litigo website or application and should be read together with our Terms of Use and Privacy Policy.

1. Subscription Plans

Litigo may offer free, monthly, and annual subscription plans.

The applicable price, billing frequency, features, limits, and other conditions will be displayed at the time you subscribe.

Prices may change from time to time. Any changes to the price of an existing subscription will be communicated in advance where required by applicable law and will generally apply from the next applicable billing period.

2. Free Plan

Litigo may provide a free subscription plan with limited features or usage.

The free plan does not require payment and therefore is not eligible for refunds.

Litigo reserves the right to modify or discontinue the free plan at any time, subject to applicable law.

3. Paid Subscriptions

Paid Litigo subscriptions are generally billed in advance for the selected billing period.

Depending on the plan selected, billing may occur:

  • Monthly; or
  • Annually.

When you subscribe to a paid plan, you authorize Litigo and its payment processor to charge the applicable subscription fee and taxes to your selected payment method.

4. Cancellation

You may cancel your Litigo subscription at any time.

Cancellation stops the subscription from automatically renewing at the end of the current billing period.

Unless otherwise required by applicable law, cancellation does not automatically result in a refund of fees already paid.

You will generally continue to have access to the paid features of your plan until the end of the current billing period.

For example:

If you subscribe on August 10 and cancel on August 20, your subscription will generally remain active until the end of the applicable billing period. You will not normally receive a refund for the unused portion of that period.

5. Refunds

Unless otherwise stated in this Policy or required by applicable law, subscription fees are non-refundable.

We generally do not provide refunds or credits for:

  • Unused subscription time;
  • Partial months;
  • Partial annual subscriptions;
  • Failure to use the Service;
  • Temporary inactivity;
  • Failure to cancel before renewal;
  • Change of mind after purchase;
  • Features that you did not use.

This policy applies whether the subscription was monthly or annual.

6. Exceptional Refunds

Although subscriptions are generally non-refundable, Litigo may, at its sole discretion, provide a full or partial refund in exceptional circumstances.

Examples may include:

  • A duplicate payment;
  • A clear billing error;
  • A technical issue that resulted in an incorrect charge;
  • A payment made after a cancellation that was successfully processed but not reflected due to a technical error;
  • Other circumstances where we determine that a refund is appropriate.

Providing a discretionary refund in one case does not create an obligation to provide the same refund in another case.

7. Duplicate Charges

If you believe you have been charged more than once for the same subscription period, please contact us promptly.

After verifying the duplicate transaction, we will generally refund the duplicate charge to the original payment method.

8. Failed Payments

If a recurring payment fails, Litigo or its payment processor may attempt to process the payment again.

We may notify you that your payment method needs to be updated.

If payment remains unsuccessful, we may:

  • Restrict access to paid features;
  • Suspend your paid subscription;
  • Downgrade your account to an available free plan; or
  • Terminate the subscription.

You remain responsible for valid charges incurred before the subscription was cancelled or terminated.

9. Automatic Renewal

Paid subscriptions automatically renew unless cancelled before the renewal date.

It is your responsibility to cancel your subscription before the next billing date if you do not wish to renew.

If a subscription renews before you cancel it, the renewal charge will generally be non-refundable unless:

  • Required by applicable law;
  • The charge was made in error; or
  • Litigo determines that an exception is appropriate.

10. Monthly to Annual Plan Changes

If Litigo allows you to change from a monthly subscription to an annual subscription, the applicable annual subscription fee will be charged according to the pricing displayed at the time of the change.

Any credit, adjustment, or treatment of the remaining period of your existing subscription will be displayed or communicated at the time of the plan change.

Unless expressly stated otherwise, changing plans does not create an automatic right to a refund of the previous subscription period.

11. Annual to Monthly Plan Changes

If Litigo permits a change from an annual subscription to a monthly subscription, the new monthly subscription will generally take effect at the end of the existing annual billing period.

Unless expressly stated otherwise, unused time on an annual subscription is not refundable solely because you wish to change to a monthly plan.

12. Downgrades

If you downgrade your subscription, the downgrade will generally take effect at the end of your current paid billing period.

You will retain access to your current plan's features until that period ends, unless otherwise communicated.

Before downgrading, you should ensure that your account complies with the storage, document, or usage limits of the new plan.

Litigo is not responsible for loss of access to features or information resulting from a downgrade where the relevant information exceeds the limits of the new plan.

13. Termination by Litigo

If Litigo terminates or suspends your account because you materially violate the Terms of Use, Acceptable Use Policy, or applicable law, you generally will not be entitled to a refund for the remaining portion of your subscription.

Nothing in this section limits any rights you may have under applicable law.

14. Service Availability

Litigo strives to provide a reliable and available service.

Temporary interruptions caused by:

  • Scheduled maintenance;
  • Emergency maintenance;
  • Infrastructure failures;
  • Internet outages;
  • Third-party service failures;
  • Security incidents;
  • Events outside our reasonable control;

do not automatically qualify for a refund or subscription credit.

Where a prolonged service interruption is caused by Litigo and we determine that a credit or refund is appropriate, we may provide one at our discretion or as required by applicable law.

15. Payment Processing

Payments for Litigo subscriptions may be processed through third-party payment providers, including Razorpay.

Payment processing may be subject to the payment provider's own terms and policies.

Refunds approved by Litigo will generally be initiated through the payment method or payment processor originally used for the transaction.

The time required for a refund to appear in your account may depend on your bank, card issuer, payment method, or payment processor.

16. Taxes

Where applicable, subscription prices may include or be subject to Goods and Services Tax (GST) and other applicable taxes.

Any refund will generally be processed in accordance with applicable tax requirements.

17. Refund Requests

If you believe you are entitled to a refund, contact us at:

  • Your name;
  • Email address associated with your Litigo account;
  • Transaction or payment details;
  • Date of payment;
  • Reason for the refund request.

We may request additional information to verify the transaction and determine whether the refund qualifies under this Policy.

18. Refund Processing

Where a refund is approved, Litigo will generally initiate the refund to the original payment method.

The time taken for the refunded amount to reach you depends on the payment processor, bank, card issuer, or other financial institution.

Litigo cannot guarantee the exact time required for a financial institution to complete the refund.

19. Consumer Rights

Nothing in this Refund & Cancellation Policy is intended to exclude or restrict any rights or remedies that cannot legally be excluded under applicable Indian law.

Where applicable law provides you with a statutory right to a refund, cancellation, withdrawal, or other remedy, that right will continue to apply.

20. Changes to This Refund Policy

We may update this Refund & Cancellation Policy from time to time.

Changes may be made to reflect:

  • Changes to Litigo's subscription structure;
  • Changes to payment methods;
  • Changes in applicable law;
  • Changes to our business practices.

When we make material changes, we will update the Last Updated date and, where appropriate, notify users through the Service or by email.

The version of this Policy applicable to a transaction will generally be the version in effect at the time of that transaction, unless otherwise required by law.
